Velmere is operated by Catorcommerce, registered in the Netherlands under KVK number 85850144, VAT ID NL004156532B14. In these terms, “Velmere”, “we” and “us” mean Catorcommerce. For questions, complaints or order support, email support@shopvelmere.com or call +31 6 85648280.
Scope and consumer rights
These terms apply to use of the Velmere storefront and, when ordering is available, purchases from Catorcommerce. Nothing in these terms excludes or restricts a consumer right, guarantee, remedy, cancellation right or other protection that cannot lawfully be excluded. If a term conflicts with a mandatory protection, that protection takes precedence.
Orders and contract formation
You must have legal capacity to enter into the purchase or the necessary authorisation. Provide accurate contact and delivery information and review the items, prices, currency, charges and applicable terms before submitting an order.
An order is a request to purchase. An automated acknowledgement confirms receipt and is not acceptance unless it expressly confirms that the order has been accepted. We will communicate acceptance or any inability to accept or fulfil the order. If payment has been taken for an order we cannot accept or fulfil, it will be returned in accordance with applicable law, without limiting other mandatory remedies. We do not reserve an unrestricted right to cancel accepted orders or change their terms retrospectively.
Prices, currency and payment
The applicable price and currency are shown with the offer and during checkout. Applicable charges that can be calculated, including tax and delivery charges, must be disclosed before you confirm the purchase; any additional charges that cannot reasonably be calculated in advance must be explained as required by law. No particular currency, tax treatment, free-shipping threshold or customs arrangement is promised by these terms.
Payment methods available for a purchase are displayed in Shopify checkout and are processed through the relevant payment providers. A payment provider's applicable terms may also govern its service. Any correction of a pricing or description error will be handled in accordance with applicable law, with notice and appropriate remedies. We will not simply substitute a higher price for an accepted order without a lawful basis and any required agreement.
Product presentation
Product descriptions identify the confirmed characteristics of the item offered. Photographs and on-screen colours can be affected by lighting and display settings, but this does not excuse a material difference from the agreed description or limit rights concerning defective or misdescribed goods. Only the contents and features expressly confirmed for the purchased product form part of its description. No unsupported wear duration, reuse count, material certification or performance guarantee is created by these terms.
Fulfilment and delivery
Orders may be fulfilled by third-party international fulfilment or shipping partners. Catorcommerce remains the seller and remains responsible for its contractual obligations and your mandatory consumer rights. You are not required to resolve a seller obligation solely with a supplier or carrier.
The destinations, charges and delivery information applicable to an order must be made available before purchase. Any delivery estimates are estimates rather than guarantees, without limiting mandatory rights relating to late delivery, non-delivery or loss. We do not promise a dispatch country, carrier, processing period, transit period, duties-paid arrangement or included import charges in these terms.
Changes, cancellation, returns and problems
Contact Velmere if you need help with an order. A request to change an order depends on its status and applicable law. Any separately stated voluntary return arrangement supplements mandatory rights; it does not replace them. Please review our Returns & Refunds Policy and Shipping Policy before placing an order.
If an item is damaged, defective, incorrect or materially different from its description, contact us with the relevant order details. We will assess the issue and provide the remedy required by applicable law. Any lawful hygiene-related exclusion from a voluntary change-of-mind return arrangement does not remove remedies for defective, incorrect or misdescribed goods. No provisional supplier process overrides your rights.
Intellectual property
Velmere branding, text, design and other protected storefront content belong to Catorcommerce or their respective rights holders. You may use the storefront for ordinary personal shopping and other uses permitted by law. Reproduction, commercial exploitation or use of protected branding without permission is prohibited except where the law permits it. Nothing here transfers ownership of intellectual property to a customer.
Acceptable use and third-party services
Do not misuse the storefront, attempt unauthorised access, interfere with security or normal operation, submit fraudulent orders, infringe others' rights or use the service unlawfully. Any proportionate restriction of misuse remains subject to applicable law and does not remove rights relating to an existing valid purchase.
Links or third-party services may have their own terms and privacy notices. Their availability does not imply endorsement. This does not exclude any responsibility that Catorcommerce cannot lawfully exclude.
Privacy, responsibility and changes
The store is hosted by Shopify. Information about visits and purchases is shared with Shopify, including for enabled enhanced services that incorporate interactions with other merchants and Shopify. Shopify and relevant third parties may process information in other countries. Shopify Network Intelligence is enabled; see the Velmere Privacy Policy and Shopify Consumer Privacy Policy for information and choices.
Personal information is handled as described in the Velmere Privacy Policy. No guarantee of uninterrupted or error-free website access is made. Nothing in these terms excludes liability where exclusion is prohibited, or removes statutory product guarantees or consumer remedies. We do not impose a blanket “as is” waiver of consumer rights or an unrestricted customer indemnity.
Updated terms apply prospectively as permitted by law. Changes will not remove rights under an existing purchase or retrospectively change an accepted order without a lawful basis and any required agreement.
Governing law and disputes
To the extent permitted by applicable law, these terms are governed by the laws of the Netherlands. This choice does not deprive consumers of mandatory protections under the laws that apply in their place of residence, including applicable Canadian federal or provincial protections. Consumers retain access to the courts, regulators and complaint routes to which they are legally entitled. No exclusive foreign-court requirement, mandatory arbitration requirement or waiver of a non-waivable consumer remedy is imposed.
